ABSTRACT Legal certainty is a central requirement for the rule of law. Legal systems should both enable those subject to law to predict human behaviour and institutional reactions and to prevent an arbitrary use of state power against them. The value of legal certainty is usually conceived as a formal value opposed to the values of freedom or equality. The purpose of this paper is to discuss this idea and to explore a less formal conception of the value of legal (...) certainty. In this sense, I will argue that we need to depart from a purely formal understanding of the requirements imposed by such value and to consider the need to provide them with a substantive content. So, legal certainty is not completely independent of legal substantive justice and it implies that it is impossible to define ex ante which concrete aspects of justice should not be the law’s concern. In this article, an attempt was made to identify the level of community social participation according to age, gender and the structural characteristics of the personal support networks in a population displaced by floods in the Colombian Caribbean. The research was based in a non-experimental methodology with an associative-relational strategy. An intentional non-probabilistic sample of 151 people affected by the winter wave in the south of the Department of Atlántico (Colombia) was selected. In total, the study included 42 males (27.8 (...) %) and 109 females (72.2 %) participants, with an average age of 37.48 (±14, Range 18 - 80) and average relocation time of 21.79 months (± 8.22, Range 5-36). The Arizona Social Support Interview Schedule (ASSIS) and Community Empowerment instruments were responded to with an instrument adapted from the leadership competence factor. The results show lower rates of intermediation in the older population, and the relationship between social participation and gender shows equally cohesive social support networks in men and women. This evidence is discussed to promote psychosocial interventions aimed to increase community engagement and empowerment of people that have experienced non-voluntary mobility processes. (shrink)

The development of Information and Communication Technologies has favored access to technological resources in adolescents. These tools provide access to information that can promote learning. However, they can also have a negative effect against people, as they can be used with other functionality, in which cyberbullying situations are caused during the interactions that arise when using social networks. The objective of this study was to determine the predictive value of the role of cyberbullying victims based on variables related to other (...) roles involved in cyberbullying and bullying, as well as personal characteristics, contextual characteristics and positive teamwork habits.. Information was collected from 227 students of the educational stages of Primary Education and Secondary Education, aged between 11 and 15 years, in a city with a high index of cultural diversity. The step-by-step technique was used to build the regression model. The results indicate that the model has a good goodness of fit coefficient. The role of cyberbully is the most important predictive variable of the role of the victim in cyberbullying and, to a lesser extent, the role of the witness in cyberbullying, the role of the witness in bullying, and the role of the victim of bullying. The role of the bullying aggressor and the variables sex, age, type of educational center, and teamwork habits are excluded in the predictive model. (shrink)

IntroductionIncorporating technology in cognitive interventions represents an innovation, making them more accessible, flexible, and cost-effective. This will not be feasible without adequate user-technology fit. Bearing in mind the importance of developing cognitive interventions whose technology is appropriate for elderly people with cognitive impairment, the objective of this systematic review was to find evidence about usability and user experience measurements and features of stimulation, training, and cognitive rehabilitation technologies for older adults with mild cognitive impairment or dementia.MethodThe Medline, PubMed, Scopus, ScienceDirect, (...) and PsycINFO databases were searched for literature published in the last 10 years, and three researchers independently reviewed potentially eligible studies, following specific inclusion criteria. A systematic review of the studies was conducted, presenting a qualitative synthesis of usability and UX measures with their outcomes, study characteristics and features of the cognitive intervention technologies.ResultsTen studies were selected: five were cognitive stimulation and five were cognitive training. Most of them were computer-based programs with a serious game format. Efficiency and effectiveness were the most frequent measurements used for collecting objective usability data, showing that elderly people with cognitive impairment require more time and help but can complete tasks. Regarding UX or subjective usability data, questionnaires and scales were the most used methods, reporting positive experience despite certain difficulties with the interface in five studies.ConclusionMeasuring usability and UX in cognitive intervention technologies for older adults with MCI or dementia provides an integrated view that can contribute to their development according to the needs and characteristics of the target population. More research is required to include this population group in usability and UX studies, as well as standardized tools and consensus on the relationship of these terms to guarantee the future effectiveness of cognitive intervention technologies.Review registrationThis review was registered in the PROSPERO International Register of Systematic Review Protocols. This need for change requires new pedagogies and new methods for teaching and learning. If personhood is the quality or condition of being an individual person, brainhood could name the quality or condition of being a brain. This ontological quality would define the `cerebral subject' that has, at least in industrialized and highly medicalized societies, gained numerous social inscriptions since the mid-20th century. This article explores the historical development of brainhood. It suggests that the brain is necessarily the location of the `modern self', and that, consequently, the cerebral subject is the anthropological figure inherent (...) to modernity (at least insofar as modernity gives supreme value to the individual as autonomous agent of choice and initiative). It further argues that the ideology of brainhood impelled neuroscientific investigation much more than it resulted from it, and sketches how an expanding constellation of neurocultural discourses and practices embodies and sustains that ideology. In this article I shall propose María Zambrano's poetic reason as a suitable method for developing a knowledge of animal being. To do so, I will follow the analyses (Derrida, Coetzee) that place animal thinking in the poetic sphere, thus showing the need for a poetic/literary knowledge to make a philosophical knowledge of the animal possible. Animal writing expresses our nature in relation to animal nature; it discloses our animal interbeingness. Finally, I will point to some of the principles of (...) ecofeminist/animal ethics, like care and empathy, which arise both in what I propose to call animal writing and in Zambranian poetic reason. This article compares political clientelism and datafied campaigning as two modes of relating politicians/parties and voters that are centred around voter surveillance. It contributes to the discussion on consequences of Big Data by showing similarities of datafied campaigns with a type of electoral politics that pre-dates the advent of mass media and is usually regarded as deficient. It thus departs from the predominant perspective on datafication and surveillance, which draws on Foucault, in order to identify the particular challenges that datafication (...) poses in the realm of democratic electoral politics. They are related to four major aspects in which datafied campaigning resembles political clientelism, as opposed to the combination of ideology, issue-based campaigning and media appeal that characterized Western European party politics in the second half of the 20th century. It personalizes the relationship between politicians and voters with the help of intermediaries; it is based on an asymmetric and iterative monitoring of voters; it implies a strong particularism and an affinity with populist appeals; and it is ambivalent with regard to the volition of voters. The identification of these similarities renders general concerns about the consequences of datafied campaigning for democracy more concrete. It offers a mirror in which seemingly novel practices are revealed to have implications that are well known to be problematic for the quality of democracy. (shrink)

In this philosophical paper, we explore computational and biological analogies to address the fine-tuning problem in cosmology. We first clarify what it means for physical constants or initial conditions to be fine-tuned. We review important distinctions such as the dimensionless and dimensional physical constants, and the classification of constants proposed by Lévy-Leblond. Then we explore how two great analogies, computational and biological, can give new insights into our problem. This paper includes a preliminary study to examine the two analogies. The idea that our universe might be modelled as a computational entity is analysed, and we discuss the distinction between physical laws and initial conditions using algorithmic information theory. All contemporary frameworks of mental capacity stipulate that we must begin from the presumption that an adult has capacity. This presumption is crucial, as it manifests respect for autonomy and guards against prejudice and paternalism on the part of the evaluator.Given its ubiquity, we might presume that we all understand the presumption’s meaning and application in the same way. Evidence demonstrates that this is not the case and that this has led to harm in vulnerable persons. There is thus strong (...) reason to question our presumptions about the presumption of capacity.We distinguish between two main ways of understanding and applying the presumption of capacity, and advocate for the one that we argue mitigates risk of harm. Our proposed interpretation offers many advantages in that it is consonant with actual practice of capacity evaluations, precludes confused and abusive avoidance of needed evaluations, and preserves the respect for autonomy motivating the presumption in the first place. Like many humans in the wake of genocide and war, most wildlife today has sustained trauma. High rates of mortality, habitat destruction, and social breakdown precipitated by human actions are unprecedented in history. Elephants are one of many species dramatically affected by violence. Although elephant communities have processes, rituals, and social structures for responding to trauma—grieving, mourning, and socialization—the scale, nature, and magnitude of human violence have disrupted their ability to use these practices. Absent the cultural, carrier groups who traditionally (...) lead and teach these healing practices, humans must assume the role. Trauma theory has brought attention to victims' severe, sustained psychological damage. Looking through the lens of trauma theory provides a better understanding of how systematic violence has affected individuals and groups and how the pervasive nature of traumatic events affects human-nonhuman animal relationships. The framing of recent trauma theory compels conservationists to create new relationships—neither anthropocentric nor powerbased—with nonhuman animals. The David Sheldrick Wildlife Trust, Kenya, shows how humans, taking on the role of interspecies witness, bring orphan elephants back to health and help re-build elephant communities shattered by genocide. Martinican philosopher, novelist, poet, and playwright Édouard Glissant and German philosopher Martin Heidegger were two such authors. Driven by a profound dissatisfaction with the logocentrism of Western metaphysics and concerns over what the tradition excluded—for Glissant, the experience of the creolized and post-colonial subject, and for Heidegger, the “Question of Being”—both advocated for more creative engagement with language and advanced particular views about the link (...) between language and Being. Through a comparative examination of the two authors’ poetics, I aim to “unconceal” an implicit dialogue between their views. I conclude by considering the implications of a key exchange in this proposed dialogue: Glissant’s substitution of Relation for Heideggerean Being. I suggest that this exchange and Glissant’s substitution make plain the problematic tendency in Western philosophy to promote an exclusionary view under the guise of universal truth, that it provides Caribbean philosophy with a greater vocabulary through which to further “produce” itself, and that it is better suited to allow for a process of unceasing transformation and creolization, in contrast to a Western philosophical emphasis on fixity. Para ello me sirvo de los feminismos materiales y utilizo los hallazgos teóricos del feminismo animalista. También examino la noción de “encierro” en tanto que concepto biopolítico que produce un nuevo tipo de ser vivo. In this paper we consider the modal logic with both \ and \ arising from Kripke models with a crisp accessibility and whose propositions are valued over the standard Gödel algebra \. We provide an axiomatic system extending the one from Caicedo and Rodriguez :37–55, 2015) for models with a valued accessibility with Dunn axiom from positive modal logics, and show it is strongly complete with respect to the intended semantics. The axiomatizations of the most usual frame restrictions are given (...) too. We also prove that in the studied logic it is not possible to get \ as an abbreviation of \, nor vice-versa, showing that indeed the axiomatic system we present does not coincide with any of the mono-modal fragments previously axiomatized in the literature. Burnout has been recognized as a serious health problem. In Portugal, before COVID-19 Pandemic, there were strong indicators of high prevalence of burnout in physicians and nurses. However, the Portuguese Health Care Service was able to efficiently respond to the increased demands. This study intends to understand how psychosocial variables might have been protective factors for burnout in physicians and nurses in Portugal. Specifically, we considered several psychosocial variables that have been found to be protective factors for burnout in previous (...) research and we compared their predictive and unique impact in the prediction of burnout. These variables are perceptions of justice (distributive, procedural, justice from colleagues, justice from patients, and their families), professional identification, meaningful work and empathy. We also included workload, as a risk factor, and controlled other variables that can be confounds for burnout, such as socio-demographic variables, ideological variables (religiosity, political orientation), and specific variables related with COVID-19 pandemic. The sample of the present study is composed by 229 physicians (aged between 23 and 70 years old,M= 36.54;SD= 10.72; 48% male and 52% female) and 268 nurses (aged between 22 and 69 years old,M= 34.96;SD= 9.52; 27% male and 73% female). An online survey was created using Qualtrics and participants were recruited via Facebook and LinkedIn. The data were collected during 29 days (between the 45th and the 74th days after the first diagnosed case of COVID-19 in Portugal). The results showed that workload was a significant risk factor, except for disengagement in physicians. The most consistent protectors across samples were procedural justice (for both dimensions of burnout, both in physicians and nurses) and professional identification (for disengagement, both in physicians and nurses; for exhaustion only in physicians). This study suggests that decreasing workload and promoting procedural justice and professional identification are key factors that might be simultaneously and independently addressed in interventions for reducing the risk of burnout or preventing it from occurring in the first place. Algunos de los argumentos que pretenden justificar el constitucionalismo desde la asunción del valor de la democracia atribuyen alguna relevancia normativa al sujeto o al procedimiento de elaboración de la constitución, considerando incompleta o incorrecta la mera apelación a una teoría de la justicia basada en derechos. Aunque los argumentos tienen orígenes heterogéneos es posible reconstruir algunos de los presupuestos que están en su base y que pueden reconducirse a los siguientes: la primacía de la democracia sobre los derechos, conforme (...) a la que éstos cobran su sentido pleno en el principio de soberanía popular; una estrategia dualista para la que no todas las decisiones políticas son cualitativamente iguales y que prima la política constitucional sobre la política legislativa ordinaria; una actitud de desconfianza hacia la representación ordinaria y la exigencia de un procedimiento diferente y más exigente para la creación y la reforma constitucional; y, por último, la neutralidad metaética y la irrelevancia de una teoría ontológicamente objetivista. A partir de estos presupuestos se han empleado principalmente dos tipos de instrumentos argumentativos para dar prioridad a la decisión constituyente y fundar en ella la supremacía de la constitución. Por una parte, se ha considerado que la analogía de las situaciones de debilidad de la voluntad individual con la democracia constitucional justifica la extensión del instrumento del precompromiso para dar cuenta de las restricciones constitucionales como vínculos autoimpuestos. Por otro lado, se ha planteado que un concepto jurídico de poder constituyente sirve para dar prevalencia a las decisiones “populares” adoptadas en una práctica deliberativa amplia frente a las decisiones parlamentarias. El hábito es una de las encrucijadas filosóficas en las que el dilema entre naturaleza y libertad se pone de manifiesto. El artículo expone la descripción que Paul Ricoeur ofrece sobre esta noción en Lo voluntario y lo involuntario (1950) y defiende que el hábito constituye una genuina y paradójica forma de libertad, pues ésta se realiza gracias y a través de la necesidad. Se tiene en consideración el difícil punto de partida de Ricoeur, quien, por una parte, rechaza lo (...) que él denomina la explicación cosmológica de Tomás de Aquino y, por otra, acoge la novedad del cogito cartesiano, siendo a la vez consciente de las limitaciones dualistas que el planteamiento conlleva. Inspirándose en Ravaisson, Ricoeur rechaza una interpretación maquinal del hábito y se acerca a la idea clásica de segunda naturaleza. En el artículo se muestran los problemas de Ricoeur en el empleo de este término y se señalan los límites de la propuesta del autor, para quien, al final, no hay sistema entre lo natural y lo libre. This article looks at the cosmopolitan potential of post-national citizenship working at the state level. The article stresses the idea of post-national citizenship as capable of translating cosmopolitan language into one that can be developed within the state-society relationship. To this end, four questions designed to clarify this relationship are raised.

The global demand for information has brought in new developments in the publicity of discursive practices of many professional areas. This study takes the professional practice of International Commercial Arbitration, a mechanism to resolve business disputes outside the courts and traditionally considered as private, to explore the process of resemiotization of information, from the strategies used by corporations in their press releases to the news reports published by national and international media. It takes the theoretical concept of interdiscursivity in critical (...) genre analysis to show that texts are the result of a combination of a very complex range of resources brought about by genres, professional practices and professional cultures, which derive not only from the ‘local’ representation of the transnational arbitration process, but also from the different corporate identities and their ways of coping with the increasing publicity of the facts of arbitration. This article is autoethnographic, based upon the authors’ experiences and reflections upon encountered moments of ethical tension whilst conducting research in rural Malawi. Given that knowledge production, as a process, has been marred by colonial forms of power, the project was underpinned by efforts to achieve a decolonial approach to the research, including the research ethics. The authors share of their endeavours to counterbalance the challenges of power asymmetries whilst researching and working with an Indigenous community whose reality can be (...) marginalised by the Western canon. The authors attempted to ensure that the values and customs of the researched community were respected and central to the research approach. When researchers are guided by local culture and customs, the participants are able to drive the research approach, incorporate their voice and share knowledge that is true to their context and reality. In this way, the research study is illustrative of how an ethics of care can help to facilitate decolonial research practice. (shrink)

Three studies are presented to validate the Spanish version of Oliver and Raney’s eudaimonic and hedonic motivations scale. In Study 1, 132 university students watched a dramatic film, filling out the scales to evaluate motivations regarding cinema consumption and reception processes. Eudaimonic motivation was associated with deeper cognitive processes during the reception and stronger identification with the protagonist. Study 2 evaluated the test-retest reliability of the eudaimonic and hedonic motivations scale. In Study 3, statistically significant age differences were observed in (...) hedonic and eudaimonic motivations. Furthermore, convergent correlations were detected between hedonic and eudaimonic motivations and preferences of different film genres. These results allow us to conclude that the Spanish version of the hedonic and eudaimonic motivations scale presents adequate psychometric properties, thus being convergent with those obtained by Oliver and Raney. Neste artigo propomos uma leitura do conto “La exportación de cérebros” (Movimiento perpetuo, 1972), do guatemalteco Augusto Monterroso à luz do conceito de cosmopolitismo do pobre, do ensaísta brasileiro Silviano Santiago. Para isso, é feita uma análise crítica e abrangente do texto, relacionando-o com a realidade dos nossos dias.

O fio condutor dos argumentos apresentados por J. S. Mill em On Liberty é de que o aperfeiçoamento da humanidade tem como fonte infalível e permanente o espírito da liberdade. Nosso objetivo é mostrar que o conceito de liberdade milliana se equilibra entre a promoção do cultivo da individualidade, na sua mais ampla pluralidade, e o desenvolvimento moral da sociedade.
